This page explains what personal information I collect through this website, why I collect it, and what you can do about it.

Who I am

ES Performance Psychology is run by me, Eddy Sheeky, a Sport & Exercise Psychologist in Training. I am a sole trader and I'm responsible for your information (the legal term is "data controller"). My business address is 41 Chapel Road, Sale, Manchester M33 7FD. You can reach me at eddy@esperformancepsychology.com or on 07463 831704.

What I collect and why

  • Enquiries. If you send an enquiry, I collect your name, email address, phone number and your message, and I use them to reply. If you're asking about working with me, the legal basis is taking steps you asked for. For any other enquiry, the legal basis is my legitimate interest in answering you.

  • Free calls. If you book a call, I collect your name, email address, phone number and anything you add. I use them to arrange the call on Zoom and send you reminders. The legal basis is taking steps you asked for before we work together.

  • Orders. If you buy or download something, I collect your name, email address, billing details and what you ordered. I use them to supply the product, send your receipt and deal with any problems. The legal basis is our contract. I also keep order records because tax law requires it.

  • Newsletter. If you join the newsletter, I collect your email address, and your name if you give it. I use them to send you the newsletter. The legal basis is your consent.

  • Browsing. If you accept optional cookies, Google Analytics collects the pages you visit, your device and browser details and your IP address. I use this to see how the site is used. The legal basis is your consent, and you can withdraw it using the cookie icon in the bottom corner of every page.

You don't have to give me any of this information, but I can't reply, book your call or supply your order without it.

Newsletter tracking

My newsletter contains a small tracking image and tracked links. I use them only to count how many people open each email and which links get clicked, so I can make it better. If you'd rather not be counted, you can block images in your email app or unsubscribe at any time.

Card payments

Wix Payments processes your card. I never see your full card number, expiry date or security code. I can see the card type, the last four digits and the name on the card.

Sensitive information

Please don't put health details or other sensitive information in the contact form or booking form. If you send them anyway, I'll ask for your explicit consent before I use them, and I'll delete them if you don't give it. If health comes up on the free call, I'll ask your permission before I keep any note of it. You can withdraw your consent at any time by email, and I'll then delete those details. If we go on to work together, I'll explain separately how I handle session notes and client records.

Under 18s

If you're under 18, please ask a parent or guardian to buy for you or to book a call. If you're under 13, please ask them to contact me for you too. You can only join the newsletter or accept optional cookies yourself if you're 13 or over. If you're 13 or over, you can ask me about your own information, and you have the same rights as an adult. If you're a parent telling me about your child, I'll use those details only to reply to you. I'll ask for your explicit consent before I use your child's health details.

Who sees your information

I don't sell your information. Wix, Zoom and Google handle it on my behalf:

  • Wix runs the website, forms, bookings, shop, email marketing and card payments.

  • Zoom runs video calls.

  • Google provides my business email and, if you accept cookies, Google Analytics.

I may also share information with my accountant, or where the law requires it.

Some of these companies process information outside the UK. Where that happens, the transfer is covered by UK adequacy regulations or by contract terms approved for that purpose. Where I rely on contract terms, you can ask me for a copy by email.

How long I keep it

  • Enquiries and bookings: up to two years after we last spoke, unless we go on to work together.

  • Orders: seven years, because I need them for tax.

  • Newsletter: until you unsubscribe. I then keep your address on a suppression list so you aren't emailed again.

  • Google Analytics: up to 14 months.

Cookies

Some cookies are essential to run the site, the shop and the booking system. Others are optional: Google Analytics shows me how the site is used. Optional cookies only run if you accept them in the cookie banner. You can change your choice at any time using the cookie icon in the bottom corner of every page.

Your rights

You can ask me for a copy of your information, ask me to correct or delete it, ask me to limit how I use it, or ask me to send it to another provider. Where I rely on your consent, you can withdraw it at any time, and every newsletter has an unsubscribe link. Some of these rights have limits. For example, I can't delete order records that I must keep for tax. Email me to use any of them and I'll reply within one month. It's free.

You have the right to object to my using your information on the basis of legitimate interests, and I'll stop unless I have a strong reason to carry on.

Complaints

You have the right to complain to me about how I've handled your information. You can use the contact form, email eddy@esperformancepsychology.com or call 07463 831704. I'll acknowledge your complaint within 30 days, look into it without undue delay, keep you updated and tell you the outcome. You can also complain to the UK regulator, the Information Commission (still known as the ICO), at ico.org.uk/make-a-complaint or on 0303 123 1113. If you live in Ireland, you can also complain to the Data Protection Commission at dataprotection.ie.

Changes

I'll update this page if anything changes, and the date at the top will show when that happened.
